Terms of Service

1. Acceptance

By using WheelWhirl (the “Service”), run by WheelWhirl, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. Who may use it

You must be at least 13 years old, or the minimum age of digital consent in your country if that is higher, to use the Service on your own. Younger children may use it only with a parent, guardian or teacher. If you use the Service for an organisation such as a school or business, you confirm you may accept these Terms for it.

3. The Service, as is

The Service is free and provided “as is” and “as available”. We may change, pause or remove features, templates or the whole Service at any time. We do not promise it will be uninterrupted or error free.

4. Acceptable use

You agree not to:

  • use the Service for anything unlawful, or to harass, threaten, defame or demean others, including in wheel entries you create or share;
  • use the Service to run any activity in which people pay for a chance to win a prize, or any other activity that needs a license you do not hold;
  • abuse share links, embeds or overlays, for example to hide malicious content or overload the Service;
  • scrape the site or use bots or automated tools to place load on it, or try to probe, disrupt or bypass its security;
  • remove the “Made with WheelWhirl” credit from embeds.

5. Giveaways, contests and draws

You are solely responsible for running any giveaway or contest you use the Service for. That includes following the laws that apply to you (which may require official rules, registration, bonding or a no-purchase-necessary entry route) and the rules of any platform you use, such as Instagram, YouTube, TikTok or Twitch. WheelWhirl is not a sponsor, promoter or administrator of any giveaway and has no part in choosing participants or delivering prizes. Our spin results are generated by a cryptographically secure random number generator, but we are not responsible for how you collect entries, verify winners or use a result.

6. Randomness and decisions

We take care that results are fair (see How Our Randomness Works), but results are for entertainment, convenience and light decision making. Do not rely on them for medical, legal, financial or safety decisions. We are not liable for any decision you make from a result.

7. Your content

You own the entries, names and images you put on a wheel. They stay in your browser and we do not receive them. When you create a share link, embed or overlay, you give the people you give it to the ability to view that wheel, and you give us only the limited permission needed to display it in their browsers. You promise you have the right to use what you add and that it does not break the law or anyone’s rights. We may disable access to wheels or content that is unlawful or that we are asked to remove (see our copyright policy).

8. Our property and other people’s trademarks

The Service, its code, design and original text belong to WheelWhirl or its licensors. You may use it as intended but may not copy it as a competing service. Team, league, game and character names appear only to describe what a wheel is about. WheelWhirl is not affiliated with or endorsed by their owners, and all trademarks belong to their respective owners.

9. Third-party services

The Service can connect to or be used with Twitch, YouTube, OBS, Streamlabs and advertising and analytics providers. Those services are governed by their own terms and privacy policies, and we are not responsible for them.

10. Limitation of liability

To the fullest extent the law allows, WheelWhirl and the people behind it are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total liability for any claim is limited to USD 100. Some places do not allow these limits, so they may not apply to you.

11. Indemnity

You will defend and reimburse WheelWhirl against claims and costs that arise from your content, your giveaways or contests, or your breach of these Terms or the law.

12. Ending use

You can stop using the Service at any time. We may suspend or block access for anyone who breaks these Terms or puts the Service at risk. Sections that by their nature should continue (such as 5, 8, 10 and 11) survive.

13. Changes to these Terms

We may update these Terms. The date above shows when they last changed, and continuing to use the Service after a change means you accept it.

14. Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules, and disputes belong in the courts of competent jurisdiction there, except where mandatory consumer law in your country says otherwise.
